Redcomet.org LEGAL stuff (rev. 1/01/03)

By using our site you and your organization understand and agree to the following:

Primary Mission of Redcomet.org program
Redcomet.org is a program designed to help educational organizations reduce dropout rates at their own school by providing accredited credit accrual courses that are mentored by educators who order them for their students. Redcomet.org is not a school and does not offer diplomas or GED certificates. We do issue transcripts upon successful completion of our courses.

Redcomet.org is not intended to assist home schooling or individual students or parents who are seeking home school materials. While Redcomet.org may, at its sole discretion accept orders from private schools and organizations, it is in no way intended as a home school program and is primarily intended for use by publicly funded institutions.

Redcomet.org does not seek, or claim FTE or other government revenue based on student enrollments, nor do we compete with schools for funding resources. Our intention is to help schools maximize funding for their own programs by helping them provide their students with alternative ways to recover credits the students need to graduate.

The Curriculum is made available for downloading solely for use by end users according to this agreement. Any reproduction or redistribution of the Curriculum not in accordance with this agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Without limiting the foregoing, copying or reproduction of the curriculum to any other server or location for further reproduction or redistribution is expressly prohibited.

The curriculum is warranted, if at all, only according to the terms of this agreement. Redcomet.org, Inc. hereby disclaims all warranties and conditions with regard to the curriculum, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant accreditation or acceptance of our credits because these rules change from jurisdiction to jurisdiction.

Notice Specific to Documents Available on this Site
Permission to use Documents (such as course pages, links to other sites, tests, and all other materials and contents and proprietary ideas) from this server ("Server") is granted, provided that (1) the below copyright notice appears in all copies and that both the copyright notice and this permission notice appear, (2) use of such Documents from this Server is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and (3) no modifications of any Documents are made. Important Excerpts from Accreditation Agreement
Agreement between Redcomet.org, Inc., a corporation duly licensed in Washington, doing business as Redcomet.org, Inc., and Toppenish School District hereinafter referred to as "the District"

2.2  In consideration ... the District agrees to allow Redcomet.org, Inc. to issue an official Toppenish transcript for credits earned by students who successfully complete Redcomet.org, Inc. courses.

2.4  This [district curriculum] approval process is intended to ensure that the District has verified that District credits are transferred to Redcomet.org, Inc. students only for completion of course work that meets or exceeds the accreditation requirements of the curriculum used in the District. By approving Redcomet.org, Inc. course offerings, the District is in no way representing that course credit will be accepted by the participating student's school district, or that the curriculum meets any requirements imposed by any governmental entity or regulatory body with jurisdiction over the school district in which the participating student is enrolled. Redcomet.org, Inc. agrees that it will not represent to any participating student that credit will be accepted by that student's district and that the participating student is responsible for obtaining approval from his or her own district prior to enrolling in the course.

Other Important Understandings
By providing this service, Redcomet.org, Inc. or Toppenish School District are not undertaking any responsibility or liability for information or publication of third parties on the Internet, even if you access them through our site.

Many states have specific benchmarks and curriculum standards and many of these are constantly changing. While our program intends to make every effort to meet or exceed your state or regions rules, laws. regulations, certifications, and all other requirements for such materials, we make no warranties whatsoever that our materials comply. The users of our site are solely responsible for compliance with their state's or jurisdictional entity's requirements, Use of our site means that Redcomet.org, Inc. and Toppenish School District are hereby held harmless for any and all claims resulting from noncompliance with such standards, including claims for refunds and restitution.

Official transcripts will be mailed out to legitimate educational organizations only, as confirmed by Redcomet.org, Inc. The address of the school/program must match the legitimate, confirmed address of the school/program. Redcomet.org, Inc. reserves the right to withhold official transcripts pending confirmation by Redcomet.org, Inc. that the intended recipient of the official transcripts is a legitimate educational organization. In no case will official transcripts be issued to individual students or parents.

Warning ... Misuse of this site by unauthorized individuals will be investigated and prosecuted to the full extent of the Law. You understand that this includes tracing your identity through your internet service provider and agree to allow us to conduct such an investigation.

Furthermore, Redcomet.org, Inc. can refuse service to whoever it deems to have violated the primary mission or intent of our program.

Billing Matters
Our courses cost $125.00 U.S. each course and if you use our site you will PAY this price in one or more of the ways listed below unless written contractual arrangements supercede this price and these terms:

Accept Money Orders
Accept Certified/Cashier Checks
Accept Major Credit Cards
Accept Paypal Payments

Redcomet.org, Inc. reserves the right to restrict or refuse orders from states where exclusive distribution rights have been granted under written contracts. For instance, if a state has an organization or school that is the exclusive distributor of our courses in that state, we reserve the right to forbid sales from that state directly from this site and refer you to our exclusive representative in that state or region who may charge more than our fee under terms of their contract.

The person who is listed as the Contact will be held primarily responsible for the payment and it will be assumed that person is authorized by his organization to sign up for this service.

Please mail your check, money order, purchase order, or invoicing instructions, the same day you place your order. If payment or billing information is not received within five (5) working days from the day you order, you (the Redcomet.org Contact) and/or your organization will be billed.

Redcomet.org must receive payment within 10 business days of your registration date. If we do not receive payment as requested, the student's access to course material will be terminated. School Districts will be given special payment allowances if a Purchase Order # is included with the registration.

NSF checks will mean the immediate end of access to the site and a charge of $30.00 will be added to the cost of the course for the NSF check.

Redcomet.org will pursue collection action and withhold transcripts and seek all available legal remedies in the case of nonpayment of services. These collection actions may include civil suit, collection action and other measures. All costs for such actions shall be added to the amount owed to Redcomet.org. Venue shall be at the sole discretion of Redcomet.org.

This legal notice serves as formal constructive notice that this agreement is enforceable. Should an organization receive this notice and wish to challenge the authorization of the person who used our site, such notice must reach us by email within 24 hours of use of our site.
